Terms of service

Last updated

These terms are the agreement between you and moime when you make an account, build pages or visit them. Please read them with the privacy policy and the content rules, which are part of these terms.

Who runs moime

moime is run by CREATIVITY IS EVERYWHERE, LLC, a New York limited liability company. In these terms, “moime”, “we” and “us” mean CREATIVITY IS EVERYWHERE, LLC. “You” means the person using moime. You can reach us at hello@moime.app.

moime lets individual creators build a page of links, photos, video, music, files, promo codes and countdowns, and share it at moime.app/your-name.

The beta

moime is in an invite-first beta. That means:

  • New accounts may need an invite. Anyone can join the waitlist at moime.app/join.
  • Every plan is free during the beta. We will tell you before anything you use starts to cost money, and nothing is charged unless you choose a paid plan.
  • Features may change, move or be removed while we learn what works. Some things will break. Report problems from the app menu (Report a problem) or by email.
  • Keep your own copy of anything important. You can download all your data at any time from Profile.

Who can use moime

  • You must be 13 or older to make an account.
  • If you live in the European Economic Area (EEA) or the United Kingdom, you must be 16 or older.
  • You must be 18 or older to buy a paid plan or a domain.

If you use moime for a business or a group, you confirm you may accept these terms for it. If we learn that an account belongs to someone under the age above, we will close it and delete its data.

Your account

  • You sign in with an email link or with Google. Keep access to that email or Google account: it is how you get in.
  • One person per account. Don't share your sign-in, and don't make accounts for other people without their permission.
  • You are responsible for what happens in your account. If you think someone else got in, use “Sign out of all devices” in Profile and tell us.
  • Don't make accounts in bulk or with automated tools, and don't get around a limit, a hold or a closed account.

Your content

Your pages, text, photos, video, files and links are yours. You keep every right you have in them.

So that moime can work, you give us a worldwide, non-exclusive, royalty-free permission to store, copy, display and send your content, only to run and improve moime for you: to show your published pages to visitors, to make previews and share images, to keep backups, to check pages against our content rules (including with the automated review described in the privacy policy), and to show your page on moime's own pages only if you agree to it first. This permission ends when you delete the content or your account, except for copies in backups, which are overwritten within 30 days, and anything we must keep by law.

You promise that:

  • you have the right to share what you upload and link to, including other people's photos, music and logos;
  • people who can be recognised in your photos and videos are fine with being shown;
  • what you say about yourself, your work, your prices and your offers is true.

If you think something on moime infringes your copyright or other rights, email hello@moime.app with the page address, what you own, and how to reach you. We will look at it, remove it where it infringes, and tell the creator.

Content rules

The content rules say what can't be on moime and what we do about it. Pages may be reviewed when they are published, automatically and by a person, and a page can be held back until a person has looked at it. Anyone can report a page. Breaking the rules can lead to content being removed and the account being suspended or closed.

Usernames

  • Your username is your address: moime.app/your-name. It uses the letters a to z, numbers and _, from 3 to 30 characters.
  • Some names are reserved for moime's own pages and can't be claimed, and some are blocked, such as slurs and names that pretend to be a brand or moime.
  • When you change your username, your old one stays held for you for 30 days: links to it lead to your new one and nobody else can take it. You can change your username 3 times in 30 days.
  • When you delete your account, your username is held for 30 days so nobody can take it straight away. After that anyone can claim it.
  • Usernames can't be bought or sold. We may take back a username that impersonates someone, breaks someone's trademark, or was registered to resell it.

Custom domains

Showing your page on your own domain is coming later and isn't available in the beta. When it is: a domain you buy through moime is registered in your name with our registrar partner, Name.com, so it is yours and you can move it elsewhere. The registrar's and the registry's own terms also apply to it. Prices, renewals and refunds for domains will be shown before you buy.

Other people's sites and services

Pages on moime link to other sites and can show players from YouTube, Vimeo, Spotify, SoundCloud, Apple Music and Google Maps. Those sites are run by other companies under their own terms and privacy policies, and we are not responsible for them. A player loads only when a visitor taps it.

Creators are responsible for what they sell or offer through their links. A purchase made on another site is between you and that seller.

Changes to moime and shutting down

We may change, add or remove features. If we remove something you rely on, we will tell you in good time where we can.

If we ever shut moime down, we will tell you by email at least 90 days before, and you will be able to download all your data until the end.

Closing an account

You can delete your account at any time in Profile, under Delete account. It is deleted at once, with your pages and files. See the privacy policy for exactly what is removed.

We may hold or remove content, or suspend or close an account, when it breaks these terms or the content rules, when the law requires it, or to protect visitors or moime. Where the content is not harmful we will usually tell you first and give you a chance to fix it. When we act, we email you what we did and why, and how to ask for another look. For the most serious cases (listed in the content rules as zero tolerance), we close the account without notice and may block you from making a new one.

Warranty and liability

We work hard to keep moime running and your content safe, but moime is provided “as is” and “as available”, especially during the beta. As far as the law allows, we don't promise that it will always be available, free of errors, or right for a particular purpose.

As far as the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost sales or lost data, and our total liability to you for any claim about moime is limited to the greater of the amount you paid us in the 12 months before the claim and 50 US dollars.

Nothing in these terms limits liability that can't be limited by law, such as for fraud, or for death or personal injury caused by negligence, or your rights as a consumer where you live.

You agree to cover our reasonable costs if someone makes a claim against us because of content you published or because you broke these terms.

Law and disputes

These terms are governed by the laws of the State of New York, USA. If there is a dispute, please email us first: most things can be sorted out that way. Otherwise, the state and federal courts in New York County, New York, have jurisdiction. If you are a consumer living outside the United States, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts.

Changes to these terms

We may update these terms. For changes that matter, we will email you or show a notice in the app at least 30 days before they apply, except when a change is needed sooner by law or to stop abuse. The date at the top says when these terms last changed. If you don't agree with a change, you can delete your account before it applies.
